The judge who ruled on this is named Tingling, as in New York Supreme Court Judge Milton Tingling, and I must say I’m all “Chrissy Matthews” at this ruling!
Judge Tingling ruled that New York City is “enjoined and permanently restrained from implementing or enforcing the new regulations,” and he added that Mayor Michael Bloomberg’s attempts at “portion control” were both “arbitrary” and “capricious.”
My thoughts exactly, and I don’t even have a fancy law degree.
Imagine the gall of some super rich FAT CAT telling the rest of America what size drink we can have. How about we tell Bloomberg what size WALLET he should carry, or how big a MANSION to buy?
“The simple reading of the rule leads to the earlier acknowledged uneven enforcement even within a particular city block, much less the city as a whole … the loopholes in this rule effectively defeat the state purpose of the rule,” the decision reads.
The fact is Bloomberg has more money than sense, and too much time on his hands.
