Justice Department Delivers Punch to Leftists

The Justice Department decided to weigh in regarding Whitaker’s appointment as the new Attorney General.

Unfortunately, democrats aren’t going to like the results.

Just as soon as Trump announced Whitaker’s appointment as the acting Attorney General, Chuck Schumer and other top ranking dems started to cry foul.

In fact, Schumer immediately demanded Whitaker recuse himself from the Russian investigation? And why? Because the dems are running scared.

Midterms ended more than a week ago. Yet we’ve heard nothing from Mueller and the report he was supposedly sitting on.

In fact, the left has one hope- that Whitaker’s appointment violates the law.

But now, the Justice Department’s legal team decided to weigh in on Whitaker’s appointment.

As the Washington Post reports:

The Justice Department released a memorandum Wednesday defending the legality of President Trump appointing Matthew G. Whitaker as acting attorney general — rejecting criticism from some lawyers that the move violates the Constitution.

Since his appointment last week, some have charged that Whitaker, who served as the chief of staff to the previous attorney general, Jeff Sessions, is not legally eligible to serve as the head of the Justice Department because he is not a Senate-confirmed official.

On Tuesday, Maryland Attorney General Brian E. Frosh, a Democrat, asked a federal judge to block Whitaker from serving as acting attorney general, arguing that Deputy Attorney General Rod J. Rosenstein should instead take on the role.

The Justice Department’s Office of Legal Counsel, which provides legal guidance to the federal government, said in a 20-page memo that past practice, court rulings and legal analysis show that the Whitaker appointment is legal. In particular, it says the scenario is expressly authorized by the 1998 Federal Vacancies Reform Act.

Obviously, this is a huge blow to the left. However, it’s no surprise to Trump. The President did his homework before he even made the move.

And once again, the bellyaching from liberals highlights the leftist hypocrisy.

WaPo continues:

“As all three branches of government have long recognized, the president may designate an acting official to perform the duties of a vacant principal office, including a Cabinet office, even when the acting official has not been confirmed by the Senate,” the memo said.

The memo notes that Trump has now done it six times, while then-President Barack Obama did it twice and that then-President George W. Bush did it once.

Interestingly, the legal opinion also concludes that even if Trump had fired Sessions, he could have replaced him with a non-Senate-confirmed government employee for a period of up to seven months, or more if a nomination was pending. By that reasoning, the president has the power to replace Cabinet-level officials at will and put them in charge of major government branches for half a year or more.

Loyalty is the new job security.

President Trump is a demanding boss. He demands hard work, integrity, and more than anything else- loyalty. That’s not a bad thing, as leftists would have you believe. However, liberals are very threatened by the man who isn’t scared to fire anyone.

Sessions seemed to be a good pick in the beginning. But as soon as he recused himself from the Russian investigation, Sessions showed his weakness. And in this volatile political atmosphere, the POTUS doesn’t have time for weakness.

Whitaker expressed a desire to put an end to this nonsense. Therefore, it’s no surprise Trump tapped him for the job.

As we previously wrote:

Trump (and America) have had enough grandstanding.

We want to know the details of every Democrat’s involvement in the Russian meddling “investigation”. From the top to the bottom.

Look at the current cast of characters.

Barack Obama – He presided over this mess. And in text messages we learned that he asked the FBI to keep him apprised of the situation.

Hillary Clinton – Her connections to the Russians are so deep, I’m sure the Russians have a code name for her.

All Hillary Clinton State Department Staffers, The Clinton Family, and anybody associated with The Clinton Foundation.

Disgraced former FBI Director James Comey – He was the lynchpin of the operation. Comey weaponized the FBI against Donald Trump. Further, he provided cover for Hillary Clinton and Democrats.

Andrew McCabe – He worked as a CaPo, aka FBI henchman.

Peter Strzok – He worked for McCabe.

Lisa Page – She was an attorney in the Department of Justice, and strategized with Strzok to bring down Trump, by any means necessary.

John Carlin – He’s a critical figure in all of this, and played a strategic role with James Clapper.

James Clapper- Obama’s director of national intelligence, whose office formally concluded in January 2017 that Russia meddled in the 2016 presidential election. He lied multiple times on TV and under oath, and knows the Democrats’ involvement to the minute level.

There are many others who should be added to this list, but I’m ending here for the sake of brevity.

Democrats are running scared, as they know how this will eventually play out. That’s why Mueller’s report is MIA. Further, that’s why they don’t want Whitaker taking the helm. And that’s exactly why Trump made this move.

Soon, it will be checkmate.
