California is a hot bed of leftism. That’s no secret. But now the California Court system proves it operates under an utter disregard of the law.
A Federa Judge is reviewing the compentacy of the murderer of Kate Steinle. And the fact that any part of this case is still brewing is a huge disgrace to the memory of Steinle and her family.
It was bad enough when Jose Ines Garcia Zarate recieved an acquittal for his actions. Only in California woud an illegal immigrant, convicted of at least seven felonies, manage to free himself by saying ‘I had the gun, but I didn’t aim at her, it just went off.’ Of course, I’m paraphrasing, but his defense was fully based upon the insinuation that he never targeted Steinle.
I’d like to know what kind of peace Steinle’s father takes from that excuse. Imagine a father, walking down the peir with his beautiful daughter, only to witness her death. And the answer he gets from a man that should 1. NEVER POSESS A FIREARM and 2. NOT BE ALLOWED IN THIS COUNTRY is “oops, I didn’t mean to kill her.”
And then we add insult to injury with an acquittal. But it gets worse, the government files new charges, for illegal posession of a firearm and immigrant in the United States illegally, and the family starts to believe there might be some justice afterall. Then BOOM! A California judge decides this guy isn’t competent to stand trial. Another delay leaving the Steinle family devastated by the lack of justice.
Incompetent? Really?
We’ve all seen the movies where a criminal pleas “insanity.” But there’s a huge difference between being crazy and being legally insane. And incompetent is another matter all together.
To be incompetent, you must be unable to help your lawyer mount a defense on your behalf. Thus, you can be both competant to stand trial AND insane.
My assessment: Zarate is both sane and competent. He’s just evil. And “evil” isn’t a legal defense.
Consider this: Zarate appeared in court this week to ask the Federal Judge to make a decision. He felt the procedings have dragged on for so long that he’d like to either change his pea to guilty OR be deported.
Make no mistake, deported is a temporary setback for this criminal. The seven-time felon faced deportation 5 times before standing trial for Steinle’s murder.
But consider the fact that Zarate understands the constitution guarantees us the right to a speedy trial as proof of his legal competence. But Zarate forget to consider one important factor. The Bill of Rights applies to citizens of the United States. As such, there is no guarantee those rights will be transferred to a illegal alien.
Still, Zarate knows how to take advantage of the system.
Call Me Crazy
I previously wrote about the rising trend among illegal aliens facing prosecution. More and more they use insanity, mental illness or mental disability to escape maximum penalties for their actions.
As Breitbart added:
In the case of illegal alien Wilbur Ernesto Martinez-Guzman — accused of murdering four Americans in Reno, Nevada — the defense is expected to claim that Martinez-Guzman is “mentally disabled” to avoid the death penalty if he is convicted.
Likewise, the 34-year-old illegal alien Apolinar Altamirano, an alleged self-proclaimed member of the Sinaloa Cartel, accused of murdering 21-year-old gas station clerk Grant Ronnenbeck in cold blood in January 2015, will not be eligible for the death penalty after he successfully got himself declared “intellectually disabled.”
It’s just one more way illegal immigrants drain the system. Now, we will waste thousands upon thousands of dollars “treating mental health” for these illegals and sadly, most of them are faking their afflictions.
Unfortunately, our courts, especially in California, refuse to take a stand. We continue to allow these manipulations. And the Steinle family is only one of many suffering the backlash.
Illegals Immigrants aren’t the only manipulators.
In an even more horrific circumstance, courts are reconsidering the verdict in the Scott Peterson murder case.
As most of us remember, Peterson’s guilty verdict closed the door on Peterson’s murder of his wife and unborn son. The tragedy played out on TV for months. Now, lawyers want a judge to throw out the verdict over Juror #7. Apparently, the juror failed to disclose herself as a crime victim.
This juror once filed a complaint against her boyfriend’s ex-girlfriend for harrassment. According to Peterson’s team, this marked the juror as prejudicial towards crime victims.
I can’t imagine anyone actully believes complaining about your boyfriend’s ex is the same thing as being the victim of domestic abuse, rape, or hate crimes. It was a simple complaint.
But again, we’ll waste our tax dollars and drag an innocent family through the mud just to “play nice” with the lefties. Peterson is guilty. Zarate is guilty. And the court system that continues to rehash the devastation has no place in our justice system.
