Will Letitia James Be Disbarred

I saw a post that Letitia James was being disbarred. I’m a bit skeptical, but not because she doesn’t deserve it. I contend that James, Fani Willis, and Alvin Bragg should all lose their law licenses over lawfare against Trump.

Here is the tweet on X that caught my attention.

 

Former prosecutor Andrew McCarthy wrote in the New York Post:

Even in its intended application, the law is vague: The AG may sue even if the alleged scheme is not actionably criminal, as long as she deems it somehow deceptive.

But §63(12) was never meant to turn the AG into what James aspires to be: the uber-regulator of all business conducted in the Empire State.

In particular, it was not intended to let the state government intrude into business transactions between financial professionals that involve no criminal activity.

Trump’s case demonstrates the monstrousness of §63(12) when stretched as James stretched it.

Trump is a longtime international real estate and business magnate, who has decades-long relationships with banks and insurers. James alleged that he engaged in persistent fraud, for over a decade, in conducting business with these counterparties.

He did so, she alleged, by inflating the value of his assets to obtain more favorable interest rates and coverage premiums. Yet none of these counterparties was defrauded; instead, they made money.

Forget the fact that Trump’s partners not only made money, but continued with other business ventures with Trump. Still, the real key for me is that James nor any other prosecutor ever went after Trump prior.

This case mimics Braggs case where he turn a misdemeanor where the statute of limitations ran out, into a felony. As for Trump’s case his partners were seasoned real-estate investors and not local yokels of whom Trump took advantage. So who was James saving from Trump? Nobody. With no fraud victims, James merely concocted fraud damages.

The world knows prosecutorial fraud when they see it. And Letitia James does deserve to be disbarred.

Where did the rumors start?

Republican Congresswoman Elise Stefanik has filed a formal complaint with New York’s Committee on Professional Standards, accusing James of bias in her investigation of Donald Trump. Stefanik alleges that James violated legal ethics by conducting a prejudiced investigation and making inflammatory public statements during Trump’s civil fraud trial. The complaint requests that James be suspended or disbarred while the matter is investigated.

Stefanik asked for James to be suspended or disbarred for violating Rule 8.4(h) regarding conduct that undermines the legal profession’s integrity​ (JURISTnews).

Stefanik is not alone in her criticism of James, as several political figures and commentators have criticized Letitia James for her handling of the Trump investigation. Many have accused her of having a long-standing personal vendetta against the former president. These critics argue that James’s past statements, including her campaign promises to pursue Trump, demonstrate a bias that undermines the integrity of her office.

Legal analysts and conservative media have raised concerns about her objectivity, suggesting that her actions are politically motivated rather than based on legal merit​.

Donald Trump himself has rightfully accused James of running a “political witch hunt”. He targeting of him is based solely on her hatred of him, and without cause. Also, renown attorney Alan Dershowitz suggested that James’s statements and actions show a clear bias. He cites her campaign rhetoric where she promised to get Trump.

The President of Judicial Watch, Tom Fitton has called her investigation politically motivated, questioning the fairness of her approach.

And it’s not like these people don’t have just cause.

James is seen on video at multiple campaign events publicly stating that she will get Donald Trump. The very existence of these videos should cause her to recuse herself from the cases, except no other prosecutor would have ever risked his or her career on such trivial nonsense.

Let’s hope that real justice is served, and Letitia James actually gets disbarred.
